Restriction of minors’ access to online pornography: solutions provided by the law

This article analyzes the ways that the Spanish legal system offers to restrict minors’ access to pornographic content on the internet. Currently, this access can be characterized as unhindered and generalized. First, the paper presents the constitutional rights and interests in conflict when restricting traffic and access to pornography on the internet. Next, it analyzes the legal regulations in force in our system that could offer a solution to minors’ access to pornography and discusses their practical usefulness. The article closes with some conclusions and proposals for regulatory improvement.

Full professor of Administrative Law at the University of Valencia. His main lines of research are related to the exercise of communication rights, the regulation of the audiovisual sector and the protection of minors. He is the author, among other works, of the following monograph: El Ejercicio de la Potestad Sancionadora de la Administración en el Ámbito Audiovisual, edited by Tirant lo Blanch in 2021. He has two six-year terms of research recognized by the CNEAI. He has spent several research stays at the Universities of Cambridge, Oxford, King’s College of London and Santa Croce (Rome).
