The shared equity credit agreement as a new credit agreement to finance the shared ownership in Catalonia

The Catalan lawmaker introduced the Shared Ownership into the Catalan Civil Code in
2015. However, since the entry into force of the Act 19/2015, there have been no acquisitions
of assets using this new tenure.
The Directive 2014/17/EU of the European Parliament and of the Council of 4 February
2014 regulates the Shared Equity Credit Agreement, which could be a new credit agreement
to facilitate the acquisitions of assets using the Shared Ownership. Moreover, the Spanish
lawmaker has transposed the Directive 2014/17/UE in the same terms than the Directive
2014/17/EU.
The aim of this paper is to facilitate the implementation of the Shared Equity Credit
Agreement in Spain once the Directive 2014/17/EU is transposed by the Spanish lawmaker to
make housing more affordable.
