Consumer mediation and arbitration: a comparative overview of the Portuguese and Spanish models

This article analyses the alternative resolution models for consumer conflicts in Portugal and Spain, highlighting the main distinguishing characteristics of the two systems. This issue is being subject to changes under Directive 2013/11/EU, of 21 May 2013 (ADR Directive) and Regulation (EU) No 524/2013, of 21 May 2013, on online dispute resolution (ODR). Therefore, it is of utmost importance to observe the impact of these European standards in Portugal and Spain.

Cátia Sofia Marques Cebola is a Law graduate and completed her Master’s degree in the Faculty of Law of the University of Coimbra in 2009, defending the thesis "Resolução Extrajudicial de Conflitos de Consumo em Portugal: novas possibilidades, velhos dilemas” (Extrajudicial Resolution of Consumer Conflicts in Portugal: new opportunities, old dilemmas). She has a PhD is Law, having defended her doctoral thesis for the University of Salamanca in 2011 on the topic “La Mediación: un nuevo instrumento de la Administración de la Justicia para la solución de conflictos” (Mediation: a new tool in the Administration of Justice for conflict solution), obtaining the Extraordinary Doctorate Award from the University of Salamanca. Her book, “La Mediación”, was published by Marcial Pons in 2013. In 2008, she completed the specialisation course in mediation at the Harvard Negotiation Institute of Harvard Law School. In terms of research, she has been involved in the following projects: EMEDEU European project - Online Mediation in Cross-Border Civil and Commercial Matters in the European Union, 2014-2016, JUST/2013/JCIV/AG/4689, funded by the European Commission and coordinated by the University of Salamanca; The “Mediación Electrónica en la Administración de la Justicia: Implantación y Desarrollo” (Electronic Mediation in the Administration of Justice: Implementation and Development) project, reference SA044U14, funded by the Autonomous Community of Castile-León - Spain, in accordance with ORDEN EDU/956/2014, of 7 November, and coordinated by Professor Fernando Martin Diz from the University of Salamanca; and in the research consortium for the DEPOCEI project, funded by the European Union in the context of the TEMPUS IV programme, coordinated by the University of Belgrade.
She is the author of several articles concerning the topic of mediation and extrajudicial conflict resolution methods and she took part in several international conferences on these themes.
She has been a lecturer at the Leiria School of Technology and Management since 2003, and since 2004 she has been the Director of the Legal Studies Research Centre (Centro de Investigação en Estudos Jurídicos, CIEJ) at the Polytechnic Institute of Leiria.
