Sports mediation: a firm commitment to conflict resolution

In the present article we will analyse the advantages of implementing mediation as the method par excellence for the resolution of conflicts in the world of sport. The concept of sports mediation will be
introduced, citing the main characteristics that should govern any sports mediation procedure. The various conflicts in the field of sport that are likely to be resolved through mediation will be described, and the areas in which its implementation is not suited will also be indicated. Next, the normative framework for mediation in Spain will be explained, as well as how the sports mediation procedures are set out in the recent laws on autonomous sports. The reasons why sports mediation is considered the ideal ADR method will be analysed in the controversies generated in the field of sports practice and federated competitions, whether amateur or professional, and sports mediation will be differentiated from sports
arbitration, particularly in the different roles adopted by the parties and the mediator and the arbitrator or arbitration panel in time to reach a solution to the conflict. We will then consider the current situation
of sports mediation in some institutions.
