The enactment of the Spanish Order in Council 16/2012 has once again raised the question of the meaning and scope of conscientious objection in clinical field. Unlike those who think that the attitude of health professionals towards this legal norm should be labelled as civil disobedience, this paper provides several reasons to deem it a case of health conscientious objection, namely a positive conscientious objection.
