This article analyses two different judgements of the Spanish Constitutional Court (judgments 130/2013 and 135/2013 on the Act 38/2003 on public subsidies) with the objective to highlight how they reflect some of the key aspects of the functioning of the State of autonomies: such as the irrelevance of the Statutes of autonomy, as the duplication and concurrence of powers, as the use of economic factors as pillars of myriad Central Government policies and decisions, as the attribution of powers to Central Government according to criteria that have nothing to do with the constitutional distribution of powers, and as the adaptability of the constitutional case-law to Central Government actions. The article concludes that the State of autonomies, in its current form, cannot provide any answer at all to self-government expectations coming from any territorial community.
