Noise, Rights and Courts: A Cross-cutting View. International and Constitutional Protection

Main Article Content

Francesc Claverol Guiu
The need to protect people from noise has given rise to a whole series of protection instruments, on an international level (above all because of the work done by the European Court of Human Rights) and a domestic level, as a result of Spain’s Constitutional Court adopting this case law. Because noise constitutes a multi-factor problem (with significant repercussions for individual citizens and society at large), an overall view of this question requires a multidisciplinary legal perspective, bearing in mind the rights and interests involved in each case and avoiding automatic solutions, one way or the other.
