Los refugiados LGTBI en España: buscar protección en tiempos de control migratorio

En la regulación de las solicitudes de refugio en España y en el conjunto de la UE por motivo de orientación sexual e identidad de género encontramos una tensión entre, por un lado, un marco de reconocimiento crecientemente inclusivo que emana de la tendencia a mejorar la protección y sustentar los derechos de las personas LGTBI sometidas a procesos de discriminación y violencia en amplias zonas del mundo; y, por el otro, la deriva restriccionista de los regímenes de refugio. El artículo examina los procedimientos del denominado paradigma disuasorio como obstáculos en el acceso al territorio y al procedimiento; así como las dificultades específicas de este tipo de refugiados en el acceso a protección a través de la aplicación de los principios de discreción y huida interna, la información sobre los países de origen y la evaluación de la credibilidad.
